Privacy & business contact information
This page explains how personal information is used in connection with The Third Business, including why we may have contacted you about a commercial opportunity.
BUSINESS CONTACTS & WHY WE MAY HAVE CONTACTED YOU
The Third Business identifies commercial opportunities and makes relevant connections between businesses. In doing so, we may use limited professional information about people who represent or work with businesses that may be relevant to an identified commercial opportunity.
This information may include your name, professional role, organisation and business contact details. We may obtain it from publicly available business sources, company websites, professional directories and other legitimate business sources.
We use this information where necessary for our legitimate interests in identifying, investigating and facilitating relevant commercial connections and developing our business. We consider whether the use of your information is necessary and proportionate, taking account of your interests, rights and reasonable expectations.
We may use the information to contact you about a specific or relevant commercial opportunity or connection. We do not retain identifiable business-contact information indefinitely simply because it might prove useful in future.
We may share information where necessary to facilitate a relevant commercial connection, or with service providers that process information on our behalf, subject to appropriate safeguards.
You can object at any time to the use of your personal information for direct marketing. If you do, we will stop using it for that purpose and may retain only the minimum information necessary to ensure that your preference continues to be respected.
You also have other rights under UK data-protection law. Details of those rights, our retention practices, how to contact us and how to complain to the Information Commissioner's Office are set out elsewhere on this page.
INFORMATION AND SOURCES
We may use your name, business contact details, organisation, professional role, correspondence and information relevant to a commercial opportunity or business relationship. We may also hold records needed to manage enquiries, agreements, payments, rights requests and website security. We obtain information from you or your organisation and from public business sources such as company websites, official registers, professional profiles and reputable business publications. We do not seek sensitive or private-life information for business development.
PURPOSES AND LAWFUL BASES
We use personal information to respond to enquiries, take requested pre-contract steps, perform agreements, identify and facilitate relevant commercial opportunities, keep necessary accounting and legal records, secure our systems, and handle rights and complaints. Depending on the activity, we rely on contract or requested pre-contract steps, legal obligations, consent where required, and legitimate interests. Where we rely on legitimate interests, those interests include operating and developing the business, identifying genuine commercial opportunities, preventing fraud, maintaining security and protecting legal rights. We do not rely on legitimate interests where your rights and freedoms override them or where PECR requires consent. Where we ask you to provide information needed to respond to an enquiry, enter into an agreement or perform an agreement, we will indicate what is necessary; without it, we may not be able to proceed.
BUSINESS OUTREACH
We may contact relevant people at corporate organisations about a service, opportunity or connection relevant to their role. We use limited professional information and screen against objections and suppression records. We do not send unsolicited electronic marketing to sole traders or other individual subscribers unless valid consent or another lawful PECR route applies. You can object to direct marketing at any time. If you do, we will stop using your personal information for that purpose and may keep only the minimum suppression information needed to respect your choice.
SHARING AND SERVICE PROVIDERS
We do not sell personal information. We may use service providers for email, website hosting, documents, storage and other business functions, and may share relevant information with a commercial counterparty where necessary to explore or facilitate a specific opportunity. We use an appropriate lawful basis and safeguards for such processing. If personal information is transferred outside the UK, we use an applicable lawful transfer mechanism and safeguards.
RETENTION
We keep personal information only for as long as it is needed for the purpose for which it is held, taking account of the nature of the relationship, whether an opportunity remains genuinely current, legal and accounting obligations, rights or complaints, and the need to respect suppression requests. Prospect and opportunity records are reviewed for continuing relevance and are deleted or anonymised when their purpose ends. Client, contract and accounting records may be retained for longer where the law or legitimate record-keeping requires it. Minimal suppression records may be retained as needed to prevent renewed marketing.
YOUR RIGHTS
Depending on the circumstances, you may ask for access to your personal information or request correction, deletion, restriction or portability, and you may object to processing. You have an absolute right to object to direct marketing. Where we rely on consent, you may withdraw it at any time. You can also complain to the Information Commissioner's Office at ico.org.uk.
COOKIES AND WEBSITE TECHNOLOGY
We use technologies needed to operate and secure the website. Where non-essential analytics, advertising or similar technologies are used, they will be subject to the consent requirements that apply. Information about current website cookies and controls is provided through our cookie information or consent mechanism.
AUTOMATED DECISIONS
We do not make solely automated decisions about individuals that produce legal or similarly significant effects.
